We could have a software escrow service. The source is kept with
a third party and in case the company that wrote the s/w dies, The
third party will give the source to the customer. 

There was an intersting discussion on this on slashdot about
1 -1.5 months ago. Try searching on slashdot for it. It is very
insightful and interesting. Several solutions have also been
mentioned to the problem you have stated.
