Yup, read this part carefully at the top of the page.

THIS FREE SPLUNK SERVER END USER LICENSE AGREEMENT (THE "AGREEMENT") GOVERNS
THE FREE SPLUNK SERVER SOFTWARE (THE "FREE SOFTWARE") PROVIDED BY SPLUNK INC.
("SPLUNK") THAT IS MADE AVAILABLE FOR FREE DOWNLOAD FROM SPLUNK’S WEBSITE
(TOGETHER WITH ANY UPDATES, UPGRADES, OR MODIFICATIONS THERETO, THE "FREE
SOFTWARE"), PROVIDED THAT THIS AGREEMENT DOES NOT APPLY TO SPLUNK SOFTWARE
LICENSED UNDER THE GENERAL PUBLIC LICENSE OR THE SPLUNK PROFESSIONAL SOFTWARE
LICENSE AGREEMENT.

That is the problem of twisting common english words. If FSF can redefine the
word "Free", so can Splunk, and they have just done that above. ;)
